1.5          The Promoter reserves the right to suspend or cancel the Competition or change any of the Competition Terms in any way it deems fit, without prior notice. 2              Entry Procedure

2.1          The Contest runs during the Competition Period on the Sportsgirl Instagram account (@sportsgirl)

2.2          To enter the Competition, an Entrant must :

a.     Follow Sportsgirl Instagram account (@sportsgirl)

b.     Comment on the Competition Instagram post [ https://www.instagram.com/sportsgirl/ ] 

c.     Tag a friend in comments on the Competition Instagram post.

2.3          An online purchase (excluding gift cards) of a Sportsgirl product is necessary to enter the Competition. Purchase must happen on Monday 18 August between 9am and 11.59pm AEST. The winner when notified in Instagram Direct Message must supply their valid invoice number to have a valid entry.

2.4          Any costs associated with accessing the Instagram account are the Entrant’s responsibility and are dependent on the Internet service provider used. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, or any other technical failures, including but not limited to any injury or damage to Entrant’s or any other person's computer related to or resulting from participation in or downloading any materials in this Competition. If for any reason this Competition is not capable of running as planned (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter) which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to cancel, postpone, or amend this Competition. 

2.5          Each Entrant may only submit one Entry. If you enter more than once, your first entry will be judged and any subsequent entries will be invalid. Any form of automated entry using any other devices or software is invalid. Entries submitted must not be offensive, defamatory or racist. Any such Entry will be invalid and the Entrant indemnifies the Promoter against all claims and costs by third parties arising from breach of this clause.

2.6          All Entries that are incomplete, illegible, damaged or do not conform with any condition of these Competition Terms and Conditions may be disqualified by the Promoter. If an Entrant fails to comply with any of the Terms, any Entry submitted will be void. If an Entrant does not provide accurate personal information in the Entry, the Promoter may determine such Entry ineligible to participate in the Competition.

3              Competition Draw and Prize Claim

3.1          The Prize will be drawn in accordance with the Draw Details. 

3.2          This is a game of chance and the winner will be randomly selected by the Promoter in its absolute discretion. The odds of winning the Prize depend on the number of eligible entries received.

3.3          The Promoter will publish the results and the one winner on Sportsgirl’s Facebook and Instagram stories on Friday 22 August.

3.4          The Promoter reserves the right to require Prize Winner to provide proof of identity, proof of age and proof of residency before issuing the Prize and proof of purchase with valid invoice number. Identification considered suitable for verification is at the Promoter’s discretion. If the documentation required by the Promoter is not received by the Promoter or its nominated agent, or the identity of the entrant has not been verified or validated to the Promoter’s satisfaction, then that Entry will be deemed invalid. 

3.5          The Promoter will endeavour to contact the Prize Winner via Instagram direct message, within 72 hours of their Entry being drawn as a Prize Winner. If the winner of the Prize is under 18 years of age, the winner must provide the contact details (such as their Instagram account, email or contact number) of their parent/legal guardian).To claim their Prize, the Prize Winner or their parent/legal guardian (if the winner is under 18 years of age) must, by the Prize Claim Date and Time, respond to the Promoter via Instagram direct message or in the manner instructed by the Promoter. 

3.6          If the Prize is not claimed by the Prize Claim Date and Time, and the Promoter has made all reasonable inquiries to contact the Prize Winner and has been unsuccessful, or the Prize Winner informs the Promoter that they do not wish to claim the Prize, the Prize Winner may be redetermined via another random draw on the Replacement Draw Date (Replacement Draw). To claim their Prize, the Prize Winner of the Replacement Draw must, by the Replacement Draw Prize Claim Date and Time respond to the Promoter via Instagram direct message or in the manner instructed by the Promoter. The Promoter will publish the results and winner/s of the Replacement Draw on or before Friday 29th August.

3.7          Entrants should check their Instagram direct messages. The Promoter will not compensate a Prize Winner who fails to claim the Prize due to unread, undelivered or incorrectly provided contact details. 

3.8          Once the Prize Winner has claimed the Prize, the full order will be refunded by our customer service team. Unsuccessful Entrants will not be contacted. The Promoter's decision is final and binding, and no correspondence will be entered into with respect to the chosen winner or winners.

3.9          The Prize Winner agrees to be contacted by the Promoter and its Partner for the purposes of arranging the supply of the Prize. The Prize Winner’s last name and initial of their first name will be published for no less than 28 days on the Competition Page following completion of the draw.

3.10       The Prize is also subject to the Prize Conditions.

6.1          The conduct of the Competition and these Competition Terms and Conditions shall be governed by the laws of Australia. To the maximum extent permitted by law, the Promoter and its Partner (and their associated entities, employees, contractors, and agents):

To the extent an event beyond the reasonable control of the Promoter or its Partner, the Competition and Prize may be cancelled or modified by the Promoter in its sole discretion.

7              Intellectual Property

7.1          Any material, including your name, image and likeness, that you submit as part of the Entry Procedure will be deemed to be non-confidential. You provide the Promoter with a royalty free, perpetual licence to use the material provided in any way the Promoter sees fit without renumeration for the purpose of promoting and marketing the Promoter, promoting the Competition, its outcome and any products manufactured, distributed, and/or supplied by the Promoter or its related companies. The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted Entry.

8              Tax 

8.1          The Promoter accepts no responsibility for any tax or other financial implications to the Prize Winner that may arise from claiming the Prize. The Prize Winner should obtain independent financial advice in this regard (at their own expense). 

9              Privacy

9.1          The collection, use and disclosure of personal information provided in connection with the Promotion is governed by the Promoter’s Privacy Policy at https://www.sportsgirl.com.au/privacy-policy.[PD4]  By entering this Competition, Entrants are ‘opting in’ and authorising the Promoter to contact them from time to time with promotional offers, product information and sale notifications.

10           General

10.1       If any of the provisions of these Competition Terms and Conditions are held to be invalid or unenforceable in whole or in part that part shall be severed from the remainder of the provisions and the validity of the other provisions and the remainder of the provision in question shall not be affected. 

10.2       Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 

10.3       These Competition Terms and Conditions shall be governed by the laws of the State of Victoria, Australia, and any dispute shall be subject to the exclusive jurisdiction of the State of Victoria.

13. All Entries that are incomplete, illegible, damaged, contain an erroneous email address or do not conform to or satisfy any condition of the rules may be disqualified by the Promoter. 

14. Following the conclusion of the Contest, Sportsgirl will draw at random Team entry from all valid entries received during the Contest Period as the winner. The draw will take place on Monday 23rd  June 2025 at 11am AEST at 11 Palmer Pde, Cremorne, Melbourne, Australia. The draw will not take place publicly. The winning Initial Entrant and the Invited Friend will be notified by email (to the email addresses registered with the Promoter) on the same date. The winners must claim their Prize by responding via email. 

15. The Promoter will publish the results and the winning Team member’s names on Sportsgirl’s Facebook and Instagram feeds, on or before Friday 27th June 2025. 

16. The determination of the winner will be undertaken in a fair and transparent manner with each Initial Entrant having an equal chance of winning. The Promoter’s decision is final, and no correspondence will be entered into. 

17. In the event of the Prize being unclaimed by Monday 7th July 2025, further draw/s will take place to determine replacement winners on Tuesday 8th July 2025 at 11am AEST. 3.3          The Promoter will publish the results and the one winner on Sportsgirl’s Facebook and Instagram stories on Monday 3 November 2025.

3.4          The Promoter reserves the right to require Prize Winner to provide proof of identity, proof of age and proof of residency before issuing the Prize and proof of purchase with valid invoice number. Identification considered suitable for verification is at the Promoter’s discretion. 3.5          The Promoter will endeavour to contact the Prize Winner via Instagram direct message, within 72 hours of their Entry being drawn as a Prize Winner.
